Pepper spray was first used in the San Antonio area in response to a domestic violence situation on October 15, 1887. A male assailant had assaulted his wife with pepper spray and she had then sought refuge in her home. The San Antonio Police Department responded to the scene and found that two people had been injured by the pepper spray. At the time, pepper Spray was not considered a deadly weapon and it was not until 1906 that it became an official police issue. The first use of Pepper Spray as an enforcement tool occurred on December 2, 1938 when officers were called to a disturbance at a local hotel. When they arrived, they found that three persons had committed suicide with pepper spray. In 1951, officers were called to another domestic violence incident at which time they discovered that one person who had been sprayed with pepper spray had lost control and attacked his partner. He was shot and killed by police after he refused orders to stop assaulting his wife. In 1978, San Antonio became the first city in Texas to adopt ordinances regulating possession of Pepper Spray by civilians. These ordinances allowed for citizens to obtain Pepper Spray only if they were acting lawfully under suspicious circumstances or while performing their duties as peace officers or firefighters within the city limits
