In 1911, Leander, Texas was the first municipality in Texas to pass a resolution legalizing the use of temporary electric shock devices for self-defense. The ordinance authorized the use of tasers as an alternative to firearms for law enforcement officials who felt that lethal force was not an option. In the early 1990s, Leander began seeing more and more complaints about people being shocked without consequence. After conducting research, city officials determined that stunners were not effective in subduing perpetrators and recommended against their continued use in the community. However, City Council voted 5-3 to continue using Stunner devices until further notice. After years of deliberations and public input, the city council enacted a ordinance banning stunners on December 1st, 2003. This ordinance became known as "The Taser Bill." It prohibits any person from using a taser or any other electric shock device as a form of restraint except under specific circumstances outlined in section 3(a) of this ordinance which are limited to emergencies involving serious bodily injury or death. Since its passage, The Taser Bill has been met with criticism by many residents who feel that it infringes on their Second Amendment rights and restricts their right to free speech and assembly. Some have also asked why there has never been a single instance where someone has died from using a taser while living in Leander. Despite these criticisms, Mayor John Hinson believes that The Taser Bill is necessary given the increasing incidents of weapon discharge within our community and the need for alternatives to deadly force solutions.
