He served until his death on January 6, 1840 due to complications from yellow fever pandemic that had swept through Texas at that time. On March 3, 1840 – just one day before his death – Houston appointed James Bowie as provisional governor of Texas due to lack of choice given that there was no other candidate for the position beyond Kenedy and Bowie had never served in any state government before becoming acting governor. Bowie served until May 14 when he resigned due to illness after only two months into his term because he could not get support from powerful political factions within Congress to pass legislation establishing new laws governing the Lone Star State during President Andrew Jackson's second term in office (1837-41). The townspeople voted on July 1 by popular vote to become part of Galveston County with a population limit set at 50% white people and 50% African Americans according to law which did not apply south side Galveston County where most slaves lived.) Three days later Galveston County commissioners met at Nicholls Square (now University Park) and passed an ordinance setting up a court system along Anglo lines with English judges instead of Spanish or French ones which would have allowed black men owning property within Hispanic neighborhoods like those around historic Seward Pointe without fear of being lynched or worse than being sold into slavery.).
