When firearms were legalized in Texas on November 15, 1895, Bay City was one of the first communities to own and operate a revolver. The founder of the city, John Fenton, had been convicted of a felony in 1892 and sentenced to six months in prison. A few weeks after the opening of the state constitution that legalized handguns, Fenton purchased two pistols from an individual for $5 each. He placed them in his pocket and walked into town square to show them off to fellow citizens. In 1896, Bay City voted to allow sales of shotguns and rifles within their limits. In 1898, Bay City became capital of Kansas County when it was split off from Brazoria County. On January 1st 1899, Texas State Legislature abolished Brazoria County and made Bay City its new county seat with jurisdiction over all but 2 percent of its population (the rural portions). The following year saw another gun purchase: This time by Mayor Fenton himself for $10 worth of pistols. The mayor decided that he would not carry any weapons on his person but instead keep them at his home as part of his “dangerous crime prevention” program. manslaughter prosecutions against individuals using their personal firearms began in earnest during this time period; most notably those carried out by Samuell Holmes (1890-1974), who killed four people with a shotgun at a house party before being apprehended and tried for murder. The first European to settle in Bay City was Captain James Fenton in 1827.
