However, because there were no other cities inKY that met all requirements for incorporation such as having a population over 1,,000 or being located within 10 miles of any other city (a requirement waived for new cities formed between 1800-1890),the application failed. After much debate among members of Congress regarding whether or not to incorporatedNicholasville into Louisville or Lexington due to its importance as an agricultural center following ratification of the act by President Andrew Johnson – who had previously vetoed similar applications –the ordinance granting incorporation was passed on February 14th by an unanimous vote with only one abstention from Senator Thomas Hart Benton (R-MO) who opposed incorporation because he saw it as another attempt by Louisville to controlNicholasville’s destiny.
