He built his home near present day Kansas State University after being offered land for free along the Arkansas River by then Governor James Kossuth. The area around today’s Capitol Hill Shopping Center – including what is now downtown Overland Park – were all part of Indian Territory when he made his claim and were ceded toKansas following the end of the Civil War under President Abraham Lincoln’s Proclamation No. 8of 1865 which stated: “All public lands within this state shall be governed by law according to their respective limits…. no person or party may hereafter settle upon any part thereof without Leave [from]the Gov[ernment].” This proclamation remains an important legal document because it exempted Indian Territory settlement from homesteading laws applicable to other settlers living within this state at that time such as farmers buying rights to farmable property from Native Americans rather than receiving deeds or mortgages like those received later through Homestead Act legislation George Armstrong Custer's claim led to some early development here - including what is now Five Points shopping center - as well as access to water supplies and grazing land needed for cattle drive operations across buffalo country at this time
