Pepper spray has been used by law enforcement in Jasper, Indiana for over a hundred years. In 1892, the Jasper City Council authorized the purchase of pepper spray to be used against criminals and anarchists that were causing public disturbance. The first use of pepper spray as a police weapon took place on September 10th, 1892. At that time, Jasper Police Chief John Hogg ordered officers to fire warning shots into the air if they saw any people with firearms trying to escape from justice. The first successful use of pepper spray as a weapon occurred on October 5th 1916 when two black men were arrested for attacking an officer during a peaceful sit-down strike at the local grocery store. In 1940, the Jasper Municipal Court became responsible for issuing citations for Disorderly Conduct during protests Outside of City Limits demonstrations organized by the American Legion and other groups who opposed World War II being waged without involvement by the United States government. As laws changed and more civilians became involved in protests outside city limits, citation rates began to decrease until they peaked in 1970 when over 100 citations were issued per day during anti-war rallies conducted by citizens within city limits. After 1971, Citation rates decreased until 1990 when they started slowly increasing again due to increased law enforcement activity related to drug dealers and street gangs moving into unincorporated areas adjacent to downtown Jasper. Since 1990 there have been occasional incidents where individuals using pepper spray have mistaken it for gunfire and fired upon law enforcement officers or bystanders which has resulted in several injuries sustained by both officers and civilians including one fatality which led to renewed debate about whether or not pepper spray should ever be used as aweapon against civilians. There is currently no approved regulation governing how long someone can hold out before passing out from exposure to OC gas after being sprayed with it
