By 1844 there were twelve buildings and twenty-four soldiers garrisoned at fort Moselle; however by 1850 only six buildings remained and one soldier garrisoned fort Moselle due to removal of all Indian occupants during Spanish America's exploration wars with Mexico City over land grants made by Manuel de Salcedo y Gómez to various Creek chiefs at that time including Samnite Chief Osceola In 1861 Lieutenant Colonel James Kenedy organized 1st Battalion (Florida Volunteers), 3rd Regiment Infantry (Volunteers) for military duty against Confederate forces invading Florida soil; 1st Battalion served under General Albert Sidney Johnston throughout most of 1862 before being mustered out in May 1865 near Tallahassee after Johnson's surrender at Appomattox Court House; 2nd battalion served under Lieutenant Colonel John Prentice until leaving for Tennessee during April 1865 but returned home that month as part of Armyof Tennessee under General Ulysses S Grant; 3rd battalion never left Florida territory until it surrendered at Gainesville on October 6th, 1865 just prior to Union victory over Confederate forces at Second Battle of Bull Run
