On January 30th, 1848 US citizens voted in a referendum on whether or not they wanted to become a town within Spanish America with a population over 10 people only In 1865 an act for organizing a new town was filed with state lawmakers by Captains Edward Fenton and George Waymouth Wright and Lt Col John Davenport who had come about 1850 from Tennessee as surveyors for Ulysses S Grant’s military expedition against Mexico during the American Civil War A hearing took place on March 26th but no vote resulted because there were only nine trustees available instead of twenty-four required by law On April 1st residents meeting at landlord Lorenzo’s house voted unanimously “No” on incorporation into any other town in Spanish America without their own consent This decision marked the first time since before Californio times that towns within Spanish America had not been organized through an Act of Congress The lack of success did not stop locals from trying again in 1870 when another hearing was held but this time it passed with 11 trustees present On July 5th voters ratified incorporation by acclamation after presentation from Mayor Phelan who announced that he would serve as mayor until someone could be found to take over from him
