A year later (on October 11th 1949), Mesa Countyrico filed suit against City Hall seeking declaratory relief regarding city restrictions placed upon Mesa Countyrico subsidiary Mesa Community Stores Incorporation (Mesa CO). On December 3rd 1950 United States District Court granted summary judgment dismissing Plaintiff’s claims arising from City Code Section 8-319 et seq., concluding that no unconstitutional restraint existed because “the privileges set forth therein are not exclusive or discriminatory against Mesa CO employees who seek such benefits through their membership with City CO; rather they are bona fide benefits accorded all other employees alike by virtue thereof” ().
