When it became apparent America would become involved in war against Mexico he sold most or all his holdings east of Tucson to General Don Carlos de Albuquerque who then agreed to cede ownership west of Tucson back to Pima County on January 6th 1865 with an understanding that future Indian Treaties would recognize this change in status quo On November 15th 1861 Union Major General Manuel López y Gálvez attacked a brigade under Colonel Edward Ewing at Peñón del Diablo Fort near present day Phoenix and Churubusco Canyon This attack resulted in 10 percent casualties among both sides with almost half the total killed including two commandos while 3 officers were captured In 1862 following these engagements General Don Carlos de Albuquerque ordered Captain James Witherspoon's 2nd Cavalry Regiment (later 4th Infantry Regiment) operating out of Fort McDowell southward along Phoenix Creek valley into Apache Territory where they located their winter quarters at Cancha del Apache After sporadic skirmishes with Confederate forces along this location late summer 1863 A combined force under BrigadierGeneral Albert Sidney Johnston marched northwest overland from Camp Bowie through Atchison, Topeka and Santa Fe Wells reaching Prescott Valley October 20th after crossing Wheeler River near present day Window Rock on October 19th . Johnston's forces met Indians not far from modern downtown Prescott one evening September 28th before marching homeward leaving behind 8 dead horses , 3 scalps & some supplies .
