On July 17th, 1864, Johnston issued orders for all civilians within 3 miles of Fort Pickens west of Mobile Bayou (now downtown Mobile) to leave for their own safety due to "a voluntary surrender by General Beauregard." This order led many local farmers and citizens who had been living inside city limits without fear of punishment or relocation into camps outside of town began exodus towards downtown Mobile where they were billeted until August 25th when their camp moved again into Fort Pickens pending further orders from Johnston. On September 2nd, Major James Hatton arrivals at Mobile with orders from Confederate HQ ordering all black soldiers within rifle range eastward along 4 roads leading out from downtownMobile towards modern day Baldwinville were met with mixed reactions since most residents saw them as liberators while some looked upon them as invaders seeking secession from United States rule. By October 15th it had become clear that Johnston's orders did not include all black soldiers within rifle range as some units including Company K under Lieutenant Colonel Benjamin Butler had turned around and rejoined their unit commanders east of DowntownMobile.. A group consisting mainly white men underCaptain Edward Smith met up with Captain Benjamin Butler's command post just east ofpresent day Midtown located on Talbotton Pike near US 11/US 21(today known as 15th St.) After hearing about this event one man armed only with a knife16 years old named Ewell decided he would rather die than go into another camp where he knew people would be killed if he encountered Confederate troops again
